Jag hittade en gammal trad om samma amne men eftersom det inte skrivits nagot inlagg sedan april 2007 sa valjer jag att starta en ny trad.

Jag har lange eftersokt en text till det PM, som jag vet gick ut till alla provinsregeringarna i maj 2006 och som instruerade myndigheterna att noggrant bevaka att inga fejkade bolag med utlandsagande kopte mark.

Jag har nu hittat en oversattning och de som har hus via bolag eller funderar pa att bilda ett bolag for andamalet, bor lasa texten.

Subject: The right of ownership of Juristic person in a company which has a foreign share holder or holders

The Ministry of the Interior and the Department of Land has made a ruling, which officers of the Provincial Governor are to follow, on the right of a juristic person of a company, which has a share holding by a foreign national, to be the owner of an area of land.

Due to the fact that the Ministry of the Interior has received a report, that a foreign national and Thai citizen or may employ a person to form a company to do business in the field of fixed properties. Initially, those involved will buy a house and land for residential purposes or for use as the head office of a limited company. Then they will change the purpose of the company in order to sell it as an entity or split it up to sell to other foreign nationals, which practice is illegal.

The Ministry of the Interior has considered ways to prevent such illegal activities or stop the purchase of land for the benefit of foreign nationals, in accordance with section 74, the second paragraph under the Law of the Land, and has agreed to set up additional procedures.

For example, in the case of a company, a limited partnership or partnership which has already registered and which has asked for the right to have ownership of the land in accordance with immovable business (other than a public company or a juristic person that has permission to have the right of the land under the other Law of Land as Section 27. under Act of promote investment B.E. 2520 or Section 44 under Act of Industry Settlement of Thailand B.E. 2522 or Immovable Funds, Bank, which were formed up under the laws of the Kingdom only, Investment company, Trust Company, an insurance company), if it can be shown that there is a foreign share holding or director, or that there are any other reasons to believe that a Thai citizen is holding shares on behalf of a foreign national, then the officer will need to make an examination of the income of all of the share holders, who are Thai citizens. Such investigations will cover the range of time of their occupancy/occupancies, the amount of monthly income, which will be recorded to be shown as evidence.

If there is a loan or loans from another person or persons, these sums will also need to be recorded as well the loan agreement inspected and a copy retained. If any of these investigations reaches the point, where the officer comes to believe that the registration and the legal processes involved are fraudulent or the officer comes to believe that person is proposing to buy the land for benefit of the foreigner under section 74, paragraph 2 under Law of Land, then that officer will need to make a full examination of all of the facts, which he will report to Department of Land for the decision of the Minister.

This memorandum is for your information and to instruct all of your officers in the procedures to be followed.
